Terms & Conditions

Any order of an item offered on the website implies the customer's acceptance of these general terms and conditions of sale. Tabio reserves the right to modify these general terms and conditions of sale at any time. The applicable general terms and conditions of sale are those in effect on the date of the order.

TERMS & CONDITIONS

1. ORDER
1.1
1.1.1 To make purchases on the site, the customer must meet the following conditions:

  • Be registered with their own name, telephone number, email address, as well as their own bank details and the postal address of their permanent residence.
  • Have a valid credit card accepted by Tabio (See Credit Cards).

1.1.2 The validation of the order and the execution of the contract between the customer and Tabio begin on the day the customer makes the online payment by credit card.
1.1.3 The customer's order may be refused for the following reasons:

  • The ordered item is no longer available.
  • The payment authorization is not validated.
  • An error occurred in identifying a price or describing an item.
  • The customer does not meet the eligibility criteria as described in the general terms and conditions of sale (e.g., uncovered delivery zone).

1.1.4 The customer will be notified in case of any problem concerning their order. In the event that any of the items ordered by the customer is not immediately available, the customer can choose between a refund for that item or the complete cancellation of the order and a full refund. The customer can also opt for the shipment of their order in two separate packages, and the second package will be sent when the item becomes available again.
1.1.5 Tabio reserves the right to refuse an order at any time and undertakes to take all necessary measures to ensure the confidentiality of information regarding the order and payment.
1.2
1.2.1 Validation and Confirmation
At the end of the order, on the page entitled "ORDER / VALIDATION," the customer will be asked to verify all the information and then click on the "VALIDATE MY ORDER" icon to confirm the order. It is important to note that at this stage, clicking on "VALIDATE MY ORDER" will constitute an electronic signature indicating the customer's definitive acceptance of the general terms and conditions of sale.
After validating the order, a confirmation email will be sent to the customer. The content of this email should be kept carefully by the customer, as certain information may be requested during future correspondence.
If for any reason the confirmation email does not arrive, the customer should contact Tabio to verify that the order has been properly recorded.
1.2.2 Declined Transaction
Likewise, Tabio reserves the right to refuse a transaction or service, arbitrarily. For example, Tabio may choose not to follow up on an order placed on its site by a professional or other entity intending to resell Tabio items to a third party. Similarly, Tabio will be entitled to refuse any order made by a customer with whom there is a dispute concerning the payment of a previous order, as well as any order not complying with these general terms and conditions of sale.
Furthermore, the customer or a third party cannot blame Tabio if the transaction is refused for the following reasons:

  • Removal of an item from online sale, whether it has been sold or not.
  • Modification or deletion of information or content published on the site.
  • Refusal of payment, cancellation, or suspension of the transaction after processing has begun.

2. PAYMENT OF PURCHASES
2.1
2.1.1 Prices
Prices are displayed in Euros and include VAT at the rate in force in Metropolitan France. The VAT (if applicable) will be adjusted to the legal rate in force in the delivery territory and will therefore be recalculated at the time of payment. Deliveries to Switzerland and any other countries outside the European Union may be subject to possible taxes and customs duties imposed by the carrier upon receipt of the package, after customs clearance.
2.1.2 Payment
The amount of the order includes the price of the items ordered as well as shipping costs. Payment for purchases will be debited on the day the order is shipped. Payment will not be made if for any reason Tabio informs the customer that they cannot proceed with the order or if the customer cancels their order in accordance with the instructions specified in our Orders - Information section. The customer ensures that the payment card used belongs to them and notes that all credit card holders may be subject to checks by the card issuer. If for any reason the issuer were to refuse authorization of a payment, Tabio cannot be held responsible for any delays or non-delivery of the order.
2.2
2.2.1 Credit Cards
Payment for purchases is made by credit card only.
Tabio accepts cards from MasterCard, Visa, Carte Bleue, American Express, Diners, JCB, and PayPal networks.
The customer's credit card will be charged when the order is shipped.
2.2.2 Security Code: "What is a security code?"
The security code of a credit card is a unique number printed on the credit card. This number is not engraved on the card and therefore does not appear on receipts. Only the person holding the card can know this number. Security codes will have a different composition and location depending on the type of credit card used.
2.2.3 Credit Card Errors
The following reasons may explain the refusal of a credit card transaction:

  • One of the mandatory fields has not been completed.
  • One or more requested fields contain incorrect information.
  • The request was received, but it could not reach the relevant service on time.
  • The billing address does not match the one indicated on the card.
  • Expired card.
  • Stolen or lost card.

2.2.4 International Payment Fees
Please note that our credit card processing agency is based in Japan. Your bank may identify your purchase as an international transaction and may therefore apply commission fees. The rules and conditions for calculating and applying these additional fees vary depending on the bank and credit card issuing companies. We advise you to consult your bank advisor if you would like more details.

3. REFUND / EXCHANGE
3.1 Damaged / Defective Items
3.1.1 In the exceptional case that an item is defective, the customer should consult the RETURNS section to learn about the procedure to follow.
3.1.2 If a return request is accepted by the Customer Service, a return reference will be communicated to the customer, who will then have a period of 15 days to return the defective items. After 15 days, the return request will be refused.
3.1.3 After accepting a return request, the shipment of a replacement item will be arranged as soon as possible. The initial shipping costs cannot be refunded to the customer; however, Tabio will bear the costs for sending the replacement items.
3.1.4 The return costs will be refunded to the customer within 30 days. The amount of the costs will be evaluated based on the initial shipping costs set by La Poste and will not exceed the sum of 20 euros including taxes.
3.1.5 PayPal transaction fees related to your order cannot be refunded.
3.2 Right of Withdrawal
3.2.1 In accordance with Article L.121-1 of the Consumer Code, the customer may exercise their right of withdrawal to request a refund for an unsuitable item. They have a period of 14 days after receipt of the order delivery to do so. The item must imperatively be returned in its original condition, and therefore in its packaging, which must not be opened or marked. Please note that the item and its packaging must be in perfect condition in order to be resold. Without this, the item will be returned to the customer at their expense.
3.2.2 In case of a refund request, the customer should consult the RETURNS section.
3.2.3 If a return request is accepted by the Customer Service, a return reference will be communicated to the customer by email. The customer will then have a period of 15 days to return the items. After 15 days, the return request will be refused.
3.2.4 The refund will be made within 30 days from the date on which the right of withdrawal was exercised.
3.2.5 It is important to note that the initial shipping costs as well as the return costs cannot be refunded.
3.2.6 Items must be returned with the delivery note and the return reference communicated to the customer to the following address:

Tabio cannot accept a return without a delivery note or without a return reference. These two elements must be included with the return package; otherwise, the exchange or return cannot take place.
3.2.7 Items that have been tried on, opened, or damaged cannot be refunded, in accordance with the law.
3.2.8 In case of return by mail, the package and its contents are the customer's responsibility until they are received by Tabio. The reshipment costs are the customer's responsibility.
3.2.9 It is highly recommended that the customer reships the items by registered mail and keeps proof of shipment, as such a document may be necessary (e.g., in case of package loss).
3.2.10 Tabio cannot be held responsible in case of loss or total or partial damage to the package during reshipment .
3.2.11 After receiving the package, each item will be checked to verify its condition and confirm the reason for the return. In case of unjustified reason or non-compliance with the return conditions, the refund request will be refused, and the package will be reshipped at the customer's expense.
3.2.12 If, however, a new reason for return could be accepted, the customer will be informed by email, and the return conditions may possibly be requalified.
3.3 Return or Exchange of Personalized Items
3.3.1 Personalized items cannot be refunded or exchanged, except if defective.
3.3.2 In the case of package return due to the customer's absence, when requesting a refund of the order, only the amount of the items, excluding shipping costs, will be refunded.
3.3.3 In the case of package return due to the customer's failure to pick up the items within the withdrawal period at an access point, when requesting a refund of the order, only the amount of the items, excluding shipping costs, will be refunded.

4. CANCELLATION
In case of cancellation, the customer should consult the RETURNS, EXCHANGE, CANCELLATION section to learn about the procedure to follow. After placing an order on the website, the customer has one hour to request the cancellation of their order. After this period, it is possible that the order has been shipped. In this case, the customer will be responsible for returning the items upon receipt, and they should ensure the procedure to follow by consulting the DELIVERY AND RETURNS section.

5. DELIVERY
5.1 Destinations
Tabio delivers to all countries listed on the "DELIVERY AND RETURNS" page.
The delivery will be sent to the address provided by the customer at the time of the order. No delivery can be made to professional addresses, post office boxes, or hotels.
5.2 Delivery Charges
The postage and packaging costs will vary depending on the destination.

5.3 Delivery Times and Receipt of Items
When all items ordered are available immediately, the delivery time is 5 to 7 business days from the date of shipment. In the event that some items from the order are not available immediately, the customer can also choose to have the order shipped in two separate packages. The second package will be sent when the item becomes available again, resulting in additional time. Tabio will contact the customer if the order exceptionally requires a longer delay, particularly in the case of personalized items. For your security, your package will be electronically tracked. Tabio will do its best to ensure fast and incident-free delivery, and cannot be held responsible in case of unforeseeable events that would delay the shipment of the package, including the following:

  • Postal service strike.
  • Social riots, war.
  • Accident on the road.
  • Flooding, fire, or other natural disasters.

The customer has a period of 30 days (from the date of package shipment) to report a non-delivered order. After this period, claims will be refused.
5.4 Reservation of Ownership Clause and Transfer of Risks
In accordance with Law No. 80-335 of May 12, 1980, the goods travel at the recipient's risk. They will remain the property of Tabio until the payment of the order, but will become the responsibility of the recipient upon shipment. Upon receipt, the customer (or the person who received the package) must ensure that the package packaging is not damaged before signing the carrier's delivery note, the signature constituting proof of verification. If the packaging were damaged, it is recommended that the customer verify that all items are inside the package and that each item is in perfect condition. If some items were damaged or missing, the customer is strongly advised not to sign the delivery note and simply note their observations on it before sending a registered letter to the carrier. However, if the items were in good condition, the customer can note their observations on the delivery note before signing it. Tabio is not responsible for package delivery, in case of loss or damage, the customer must contact the delivery service provider to file written claims by registered mail within 48 hours following receipt or passage of the carrier. It is recommended that the customer send a copy of this letter to Tabio.

6. INFORMATION ABOUT ITEMS

Each item visible on the website is sold within the limits of available stocks. We will take all necessary measures to ensure that the details, descriptions, and prices of the items appearing on the website are accurate at the time the information is entered into the system. 6.2 Prices
Prices are indicated inclusive of VAT (if applicable) at the applicable rate at the time the information is entered into the system. Only the prices indicated at the time of the order will be charged. However, Tabio reserves the right to modify its prices without prior notice at any time. During annual sales periods, fixed by prefectoral decree, the discounted items will be indicated on our website. Please note that these items cannot be exchanged or returned.
